Regulations of the ZAQUAD shop

 §1 Information about the shop

The online shop, which can be found at the website address: www.zaquad.eu, is run by the company ZPHU DANA Danuta Banaczek with its registered office in Skarżysko Kościelne, address: Kolonia 82B, entered in the register of businesses under number 50/89 by the Head of Skarżysko Kościelne Commune. NIP (tax identification) number: 664-100-15-97. REGON (statistical) number: 290199494.

§ 2 Orders

2.1 Order placement

Orders can be placed in the www.zaquad.eu online shop 24 hours per day, 7 days a week, through the www.zaquad.eu website.

To place an order, it is necessary to choose products from the product range offered by the shop, choose the colours, sizes and quantity of the products through “adding” them to the shopping cart. Subsequently, the following needs to be indicated in the part called “the Shopping Cart”:

  • the goods ordered,
  • address to which the goods are to be delivered and address which is to be mentioned on the invoice/receipt (it can be two different addresses),
  • method of delivery,
  • method of payment.

After placing the order, an email shall be sent to the Buyer, informing that the order has reached the  shop.

2.2 Order delivery

An order is delivered when the shop receives an email from the Buyer, containing a confirmation of the placed order.

Order delivery time is:

  • in the case of PayPal payment – from 2 to 14 business days from the date when the amount due credits the shop account. If such payment is not recorded within 48 hours (on business days) from the moment of placing the order, the purchase shall be cancelled automatically.
  • in the case of payment by bank credit transfer (prepayment) – from 2 to 14 business days from the date when the amount due credits the shop account. If such payment is not recorded within 48 hours (on business days) from the moment of placing the order, the purchase shall be cancelled automatically.

Time to receive the order = time for execution + time expected for the delivery.

All comments and information about the method in which the Customer wants their order to be delivered should be inserted in the window entitled “comments concerning the order”.

The condition for an order to be delivered is the availability of goods in warehouse. Should some of the ordered goods not be available, the Customer is informed via an email or telephone about the order status and they decide about the method of order execution (partial execution, extending the time for delivery, changing for another colour or model, cancelling the entire order). A Customer may introduce changes to the order until the moment the goods are dispatched, which can be done by calling the Hotline.

The www.zaquad.eu online shop shall not be liable for the non-delivery or a delay in the delivery of the ordered goods or in the order execution, which result from errors in the address for delivery or an inaccurate address given by the Customer.

By placing an order, a Customer concludes a sales agreement concerning the ordered goods with the company ZPHU DANA Danuta Banaczek. We reserve the right to refuse to deliver an order  in the case of errors in information displayed on the website of the online shop. The Customer, who has placed an order, shall be informed about the existing situation via email.

2.3 Cancellation of order

A Customer may cancel an order, without giving the grounds for doing so, within 14 days from delivering the goods to the customer, through calling the Customer Service department via Hotline or sending a message to the email address available on the website www.zaquad.eu in the Contact tab.

A cancellation may concern the whole or part of order that has been placed. If the payment has been made in advance via a bank transfer, the amount due shall be refunded to the Customer’s account from which the payment was made or after prior agreement with the Customer Service department.

2.4 Right to withdraw from the agreement /returning goods

All goods ordered in the www.zaquad.eu online shop can be returned without giving grounds for doing so within 14 days from delivering the  goods to the Customer. The goods must have the original packaging, they cannot bear traces of use. The only costs to be incurred by the Customer are the costs of dispatching the goods to the company ZPHU DANA Danuta Banaczek, address: Kolonia 82 B, 26-115 Skarżysko Kościelne. It is also necessary to enclose the invoice or receipt and a withdrawal form with the dispatch. We need to be informed via email about the Customer’s intent to return the goods before the returned goods are dispatched.

If the payment for goods was made in advance via a bank transfer, the amount due will be refunded  to the Customer’s account from which the payment was made or to the account number indicated in the used for withdrawing from a distance contract within 14 business days. The shop guarantees the refund of the amount equal to the price of goods with an additional charge in the case of “cash on delivery” payment. The shop shall not refund the costs of dispatch incurred by the Customer if the returned goods are sent back to the shop.

At the moment of receiving the dispatch, the Customer should check the content of the package in the presence of the courier, in order to verify whether the content is compliant with the order and whether no damage has occurred during transportation. If the Customer does not check the content of the package in the presence of the courier, complaints related to the above clause will not be taken into consideration. Should such situation occur, it is necessary to prepare a damage report in the presence of the courier, to inform the company of this fact and to send the package back to our address.

2.5 Complaints

Should the Customer receive faulty goods, they are entitled to make a complaint concerning such goods. The Customer may replace goods with new ones, however if no goods are available in the warehouse, the Customer is entitled to a refund. The Customer has 30 days to submit a complaint, starting from the date of receiving the shipment. The complaint is dealt with by the www.zaquad.eu online shop within 2 weeks from receiving the returned goods. A complaint can be rejected for lack of receipt, VAT invoice, lack of letter of complaint or as a result of the fact that the goods were damaged  during transportation to the Customer or after they were received by the Customer. The Customer shall bear the costs of delivering the goods being the subject of complaint to the company’s warehouse: ZPHU DANA Danuta Banaczek, address: Kolonia 82 B, 26-115 Skarżysko Kościelne. Refunding costs of delivery is dependent upon the acceptance of a complaint.

2.6 Replacement of goods

Each item may be replaced with another one with a different size or colour. In the case of replacement, the receipt received with the package shall be enclosed with the shipment and the size or colour of the product with which the originally bought one shall be replaced needs to be marked on the receipt.

The replacement of goods requires that the Customer incurs the costs of shipment of the replaced goods to the warehouse of the company: ZPHU DANA Danuta Banaczek, address: Kolonia 82 B, 26-115 Skarżysko Kościelne.

§ 3 Prices of goods

The prices available on the website of the www.zaquad.eu online shop are gross prices and they are inclusive of VAT. The prices provided by each product are inclusive of delivery costs.

The www.zaquad.eu online shop issues VAT invoices.

The www.zaquad.eu online shop reserves the right to change the prices of goods included in the shop offer and to cancel all kinds of promotions or sales.

In the case of purchase with an invoice, the Customer shall authorize our company to issue a VAT invoice without the customer’s signature.

The prices available at the website of www.zaquad.eu online shop are final and binding prices, which are non-negotiable (discount will be applied only in the case of orders involving more than 10 units and after agreement with the Customer Service department).

§ 4 Forms of payment

Payments for goods which are to be delivered within the territory of Poland can be made:

§5 Delivery

Shipments are delivered by the courier company Poczta Polska , pursuant to an agreement concluded  with the company ZPHU DANA Danuta Banaczek. We offer free delivery by the courier Poczta Polska.

The courier company delivers a shipment within 3 – 7 days from the moment of sending it and ZPHU DANA Danuta Banaczek shall not be liable for the courier’s failure to comply with the applicable deadlines.

With shipments of more than 3 kg weight (approx. 4 product units), the prices for delivery shall be calculated individually, according to the price list.

It is possible to collect the goods in person, in the seat of the company ZPHU DANA Danuta Banaczek, address: Kolonia 82b, 26-115 Skarżysko Kościelne.

§ 6 Protection of personal details

By their registration in the www.zaquad.eu online shop, the Customer agrees to place their personal data in the base of the www.zaquad.eu online shop and to have the data processed for marketing purposes solely by the www.zaquad.eu online shop. The Customer’s personal data is protected in accordance with the Act of 29 August 1997 on the protection of personal data (Journal of Laws
no. 133, item 883) in a manner preventing access thereto by third parties. According to the act mentioned above, the Customers have the right to view their data and they have the right to modify or remove such data, after sending an email to our company with a request for removing an account from the shop, as only the administrator/owner can access this function.

§ 7 Final provisions

The availability of a given product is indicated on the website: www.zaquad.eu and it may change from time to time.

The www.zaquad.eu online shop shall not be liable for the administrators blocking the mail servers used for sending messages to the email address provided by the Customer or for removing and blocking emails by the software installed on the computer used by the Customer. In the case of not receiving e-mail correspondence, we request that you telephone Customer service.

Differences resulting from individual settings in a Customer’s computer (colour, proportions, etc.) cannot be the grounds for a complaint and return of the purchased goods in the www.zaquad.eu online shop.

The www.zaquad.eu online shop shall exercise due diligence to ensure that the content of the goods sales offer is as close as possible to the actual situation. Given the possibility of errors that may occur during updating (e.g. of prices, settings, etc.) – any discrepancies will be adjusted during order confirmation by the www.zaquad.eu online shop.

The provisions of the Polish Civil Code shall be applicable in all matters which are not governed in these Regulations. Should any disputes arise, the right place to decide the case shall be the court with jurisdiction over the seat of the company ZPHU DANA Danuta Banaczek.

The www.zaquad.eu online shop reserves the right to introduce changes to these regulations.

The Regulations shall be applicable from 25 December 2014.
